Sibos 2012 Terms and Conditions - Registration Policy
Registration for and participation in Sibos are subject to this Registration Policy. By submitting your registration for Sibos, you will be considered to have agreed to this Sibos Registration Policy.
Interpretation• 'Sibos' means the 2013 Sibos event organised by or for SWIFT from 16 September- 19 September 2013 at the Dubai World Trade Centre P.O. Box 9292; Dubai; United Arab Emirates
• 'Sibos Registration Office' means Grass Roots DMS, the company registered in the UK to which SWIFT has sub-contracted the registration to Sibos.
Sibos is exclusively open to representatives from SWIFT Users (that is, SWIFT Members, Sub-members and Participants), representatives from exhibiting companies and other persons invited or approved by SWIFT.
All registrations must be made in advance online via the official Sibos registration website only.
SWIFT acknowledges receipt of registrations. As a principle, registrations are processed on a first come, first served basis. Once capacity is reached, any further registrations are put on a waiting list. SWIFT reviews registrations with a view to ensure appropriate representation from the targeted audience. SWIFT will promptly notify the persons whose registrations could not be accepted. In any event, confirmation of registration is conditional upon full payment.
Organisations wishing to centralise or limit their worldwide registrations are requested to appoint a central contact person. Details of that person should be communicated to Véronique Hannecart at SWIFT (e-mail: Veronique.HANNECART@swift.com). Each exhibiting company must have one nominated central co-ordinator.
Sibos registration fees are as set out on the official Sibos registration website.
The registration fee for a participant includes participation in the conference, access to the exhibition, access to all or part of the Sibos Tools, one copy of all Sibos publications, and scheduled meals (optional).
Registration fees and any other related fees and charges are net of any taxes, such as, but not limited to, VAT (when applicable).
VAT(or any other indirect taxes)
For the correct application of the VAT rules, or similar indirect taxes, the customer is deemed to be located at the place of the 'Company details' as reported on the Sibos Registration form. Upon specific request the invoices can be sent to the place indicated under 'Invoice details'. The billed entity remains however the 'Company details' entity.
All fees for "on-site" services related to participation at Sibos 2013 are not subject to VAT in Dubai. On-site services are defined as services delivered and consumed in Dubai. This covers mainly registration fee and passes, exhibitor packages, on site advertising in publications, city advertising and rent of meeting rooms. Fees and charges are net of any local taxes applicable in the country of the Customer, such as, but not limited to, VAT (when applicable) or withholding tax of any nature whatsoever. All present and future Customer's local taxes, as well as fines and/or penalties and/or interest assessed directly or indirectly on such amounts (if any) which may apply to fees or charges due for or in connection with the Conference, will always (even retroactively) be borne by the Customer.
All fees for non-"on-site" services will be subject to the rules defined by the European VAT Directive EC/2006/112.
Customer's local taxes such as withholding taxes, VAT, business taxes or other similar taxes are not included in SWIFT fees and charges. The customer is solely responsible for paying any such local taxes in addition to applicable SWIFT fees and charges. SWIFT cannot be held responsible for seeking any refund of such local taxes, and will not initiate any procedure to that effect.
SWIFT accepts payment for Sibos registration by credit card, electronic transfer or cheque. If you prefer to pay by electronic transfer or cheque, please indicate your intention to do so by using the appropriate section on the official Sibos registration website. A pro forma invoice with relevant payment instruction details will be sent to you via a link in your confirmation email.
Cancellation of Registration
Full refund (less a EUR 200 cancellation charge) of the registration fee paid to SWIFT will be made on written notification of cancellation received by the Sibos Registration Office or made online via the official Sibos registration website before 16 August 2013. No refund will be made in case of cancellations received after that date. Registrations made after 16 August 2013 are non-refundable in case of cancellation.
The cancellation of a Sibos registration will automatically cancel any hotel reservations associated with that registration. Hotel cancellation charges might be charged to the participant.
You may transfer your registration to another person within the same organisation at any time on written notification received by the Sibos Registration Office. The deadline for submission is five working days before the opening of the event.
The transfer of any associated hotel reservations require credit card details of the substitute to be communicated to the official appointed housing agent. For the avoidance of doubt, the transfer of hotel reservations is subject to the reservation terms and conditions, including where applicable any hotel guarantee provisions.
If a transfer of registration results in a refund and new payment, the EUR 200 administrative cancellation charge will be charged to the participant.
Event Cancellation, Postponement or Alteration
If, for any reason whatsoever, SWIFT is forced to cancel, postpone or materially alter Sibos, in whole or in part, it will use all reasonable efforts to notify all registered participants reasonably in advance thereof. As sole and exclusive right and remedy, full refund of the registration fee paid to SWIFT will be made on reasonable demonstration to SWIFT that such cancellation, postponement or alteration adversely affects the participant concerned.
Event Rules and Regulations
Whilst participating in Sibos, you are required to comply with any policies or directions (such as but not limited to security, health, and safety regulations) in force at the time of the event, given by or for SWIFT or any other relevant third party, including the person responsible for the premises where Sibos takes place or any competent authority.
In that respect and in particular, SWIFT notifies hereby all participants that usage of alcohol is strictly regulated in Dubai and that SIBOS participants shall only drink where and when specifically authorised. Breach of such rule of conduct could lead to very high fines for SWIFT and/or the individual. SWIFT reserves the right to terminate the participation to the event of any non-complying participant.
For security purposes, SWIFT will supply picture-ID badges. You must wear your badge at all times. Your badge is strictly personal and may not be transferred to another person nor modified.
SWIFT accepts no responsibility for any belongings you may bring to Sibos. Bringing such belongings is at your own risk.
SWIFT may process, and instruct its subcontractors to process, personal data supplied during your Sibos registration, including registration on the Sibos Tools, for purposes relating to Sibos registration (including securing your event registration, hotel registration and local destination management as well as facilitating registration to and organisation of following SIBOS events), administration, security management, accounting, record keeping, to offer Sibos related products and services (such as the Network book and the Sibos Tools), for conducting surveys and, more generally, for the exercise of SWIFT's obligations, rights and remedies. Unless otherwise provided here-below, SWIFT will keep the data collected for a period of three years.
You acknowledge and agree that, where SWIFT sub-contracts these tasks to an external supplier (typically to the Sibos Registration Office or for conducting the Sibos evaluation survey), this may involve the transfer of your personal data to non-EU Member States.
For business continuity purpose, the Sibos tools including registration and related data are fully copied on a server located in the country where the Sibos event is held.
The Sibos Tools include: Sibos Network book (in electronic form (pdf)), Sibos.com (including the restricted pages for delegates), Sibos registration, Sibos on line, conference content management and Sibos Mobile Application.
Subject to registration terms, the Sibos Tools will be made available to all Sibos participants, speakers, Sibos media partners, and exhibiting companies. The Sibos Network book and the Sibos Tools, include a participant list, excluding those participants who specifically objected to their inclusion. The Sibos Network book and the Sibos Tools are made available to you for networking, preparation of the event, and follow-up purposes. The Sibos Tools allows you in particular to contact and exchange information with other Sibos participants and exhibitors.
THE FOLLOWING CONTACT DETAILS: NAME, TITLE, AND ADDRESS DEMOGRAPHICS, AREA OF INTEREST AND PICTURE, WILL BE INCLUDED BY DEFAULT IN THE SIBOS NETWORKBOOK, AND ALL SIBOS TOOLS. . If you decide not to be referenced at all, you must expressly communicate this request in writing to the Sibos Registration Office (email: email@example.com). In such case, please note that you will not be able to make full use of the Sibos Tools.
When setting up your profile during the online registration process, you can also opt to make additional personal data (such as your e-mail address, telephone number, social media ID) available to all Sibos participants, speakers, Sibos media partners, and exhibiting companies. If you opt-out to the publication of these additional personal data, you will still be able to share those data, electronically through the Sibos Tools, with another Sibos participant upon individual request.
You can update your setting at any time through My Profile on Sibos.com.
If you provide the personal data of another person, you shall ensure that (i) that person has been duly informed about SWIFT's right to process such personal data as set out herein and (ii) such personal data are collected and supplied in accordance with applicable legislation and without infringing such person's or any third party rights.
Each participant has the right to consult and correct its personal data by addressing a request to SWIFT's Privacy Officer (firstname.lastname@example.org).Direct Marketing
The list of Sibos participants who registered within deadline is sent in advance of the event to the exhibiting companies and the Sibos media partners to allow them to present their products and services directly to you. Considering exhibiting companies and Sibos media partners may be located in any country, this involves the transfer of your personal data to non-EU Member States. SWIFT allows you to opt out of this list in the online registration process under data privacy section.Photographs and videos
SWIFT reserves the right to photograph and videotape all Sibos events and participants and to use and license such photographs and videos in any internal and external communication referring to Sibos, such as on its websites and intranet, on the Sibos Tools, in the Sibos Issues, Sibos Programme, Dialogue issues, Exhibition Guide, Wrap-up report, Sibos Network book and in its annual reports as well as on social media channels such as Twitter, Flick'r, Linkedin, Facebook or YouTube. You hereby consent to such uses.Badge scanning
The badge scanning technology that SWIFT uses at Sibos only detects your passage through a Sibos checkpoint. Your badge contains merely a unique identifier which is recorded on a central server each time you pass a secure Sibos checkpoint.Purposes
The data collected by your badge will allow SWIFT to evaluate attendance to sessions, lunches, and the event in general based on statistical data. SWIFT will only use such statistical data for purposes of evaluating sessions and the event in general, and of improving catering arrangements of future Sibos editions.Type of data used
To evaluate sessions, only the following limited number of data attributes per delegate will be aggregated in a report per session: type of institution, type of function, area of responsibility, market area and locations. SWIFT will not use any other data (such as name, email, address, phone) to produce those reports.
Targeted communications - opt out
SWIFT may also reconcile data collected by our badge with your email address to send you targeted communications relating to your Sibos participation or next Sibos events, except if you expressly communicated your request in writing to the Sibos Registration Office not to share your information for that purpose.
Who is Where
By using the SIBOS Mobile Application connected to the Wifi , you will have the option to activate the "Who's is where" feature which will give your exact location in the conference centre and will facilitate your navigation. You can also activate the option whereby other participants can find where you are located in the conference centre.
The data collected by the application are the same as those collected through the badge scanning and will be used for the same purpose as further defined here-above.
Lead Retrieval Device
Exhibiting companies can order separately a Lead Retrieval Device that allows them to scan badges of Sibos participants as to obtain reports on attendance.Purposes
This device is licensed to the exhibiting companies for the purpose of scanning Sibos participants' badge only on their stand location or at a location where the Company is organising event, cocktails, dinner. The exhibiting companies are not authorised to use the device in any other area, such as in conference rooms or in the Open Theatre.
Scanning of your badge by an exhibiting company should always be done with your express consent.
By scanning your badge, the exhibiting companies will collect your first name, family name, institution; location and e-mail address. This information should only be used by the exhibiting companies for the purpose of evaluating attendance and to present their products and services directly to you.
SWIFT will allow you to access and use the free Wifi of the conference centre. You are required to use the WIFI legally, professionally and in a way that would not violate the right of any third-party or create any interference on the network. The access to the Wifi will be restricted through an identifier code provided to each SIBOS participant. Such code will be associated with your registration data. SWIFT will not share such data with any third-parties except in the case of a legal investigations related to an unauthorised or illegal usage of the network. For that purpose, SWIFT will keep the contact details related to each identifier code for a period of 6 months after SIBOS.
SWIFT reserves the right to subcontract the processing of data collected (such as the reconciliation of your badge data with your registration details). In such case, the appointed subcontractor may only process the data upon instructions of S.W.I.F.T. SCRL (based in Belgium), which is responsible for the data processing.
By accepting to be a speaker at SIBOS, you agree that SWIFT records your sessions and uses and distributes the video for commercial purposes as further specified under the photographs and videos section here-above.Rating
Any SIBOS participant using the mobile application and the Sibos online for delegates can use a specific application allowing them to rate the sessions and speakers. The rating results will be processed by SWIFT for statistical purposes. The average result from all rating per session and per speaker will then be published through the Sibos Tools.
You acknowledge and agree that you will indemnify SWIFT against any damages incurred by SWIFT as a result of a third party claim arising from your Sibos registration or participation, except to the extent such damages were caused by SWIFT.
SWIFT's potential liability in connection with Sibos (whether in contract, tort or otherwise) is limited to the total amount of your registration fee. Furthermore, any claim for indirect, special or consequential loss or damage of any kind or for any loss of business or profit, revenue, anticipated savings, contracts, loss of or corruption to data, loss of use, loss of goodwill, interruption of business or claims of other parties or other similar pecuniary loss howsoever arising, even if SWIFT has been advised of their possibility, is expressly excluded.
To have a valid claim against SWIFT relating to your Sibos registration or participation, you must notify SWIFT within one year after the Sibos ending date. You agree to exonerate SWIFT from any liability relating to claims notified after that time limit.
Applicable Law and Dispute Resolution
This Registration Policy and, more generally, all matters relating to registering for or participating in Sibos shall be governed by Belgian law and, as regards any claims against SWIFT, you agree to submit to the exclusive jurisdiction of the competent court of Brussels, Belgium.
The Tools contain proprietary materials of S.W.I.F.T. SCRL and/or of its suppliers. All rights reserved. Any and all rights, including title, ownership rights, copyright, trademark, patents, and any other intellectual property rights of whatever nature, in the services or products described in these Tools, including any associated processes or any derivative works, will remain the sole and exclusive property of SWIFT and/or its suppliers.

The Tools may contain links to other websites, which are not controlled or maintained by SWIFT. Please note that SWIFT is not responsible for the content of those sites. The inclusion of such links does not imply any endorsement of these sites.
Code of ConductSWIFT values and encourages freedom of expression. To maintain a right balance between such freedom of expression, and potential abuses of the Tools, you agree to:
- always respect SWIFT's name, reputation, goodwill and other business assets when using the Tools
- in particular, respect the SWIFT Trademark Guidelines when referring to SWIFT or its products and services
- ensure that any content that you make available does not infringe the rights of SWIFT, another user, or any third party
- in particular, refrain from infringing any intellectual property rights, privacy and data protection laws, confidentiality commitments, trade or business secrets, banking secrecy, or other laws when using the Tools.
- refrain from making any statements that would be insulting, threatening, libelous, obscene, offensive to religious, political or ethical beliefs, discriminating or racially oriented, or otherwise infringing any applicable legislation or third party rights
- refrain from making any statements that would be disrespectful, misrepresenting, or otherwise harmful to SWIFT, another user, or any third party
- refrain from discussing topics with competitors that could give rise to competition law issues (such as price-fixing or market allocation agreements), and always conduct discussions with competitors in accordance with applicable antitrust regulations
- refrain from using the Tools to participate in or send contests, pyramid systems, or chain letters
- refrain from sending or posting unsolicited e-mails or internal messages (spam) to other users.
SWIFT SHALL ONLY BE LIABLE FOR COSTS, LOSSES, CLAIMS, DAMAGES, EXPENSES OR PROCEEDINGS OF WHATEVER NATURE INCURRED OR SUFFERED BY YOU ARISING DIRECTLY IN CONNECTION WITH YOUR USE OF THE TOOLS AND ITS CONTENT, UP TO THE AMOUNT OF FEES PAID BY YOU UNDER YOUR SIBOS AGREEMENT WITH SWIFT. SWIFT SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES.
